Welcome to Plotted Plants (“we,” “our,” or “us”), a Storycraft Tools platform. By accessing or using our platform, including our web platform, admin console, and mobile-responsive website (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms”).

1. Acceptance of Terms

By creating an account, accessing the community portal, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. User Accounts and Platform Access

  • Account Registration: You must provide accurate information when creating an account or applying to a waitlist.
  • Account Security: You are responsible for safeguarding your login credentials and for all activities that occur under your account.
  • Community Roles: Depending on your role (e.g., Member, Community Coordinator, Caretaker), you may have different access levels to community gardens, plots, and maps. You agree to use these features responsibly and not exceed your authorized access level.

3. Platform Usage and Conduct

The Services allow you to digitally manage garden plots, view interactive maps, and coordinate with communities.

  • You agree to use the Services only for lawful purposes.
  • You agree to respectfully interact with other community members and coordinators.
  • You shall not disrupt or attempt to bypass any security features (e.g., attempting unauthorized portal access).

4. User-Generated Content

  • Content Ownership: You retain ownership of any data, plant photos, plot logs, or notes you submit to the Services (“User Content”).
  • License to Us: You grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute your User Content for the purpose of operating the Services.
  • Content Standards: You agree not to upload any content that is offensive, illegal, or infringes on third-party intellectual property rights.

5. Billing and Payments

If applicable, you may make payments or donations through our Services. All payments are processed through our third-party payment processor (Stripe). By providing a payment method, you authorize the charge of any applicable fees.

6. Intellectual Property

All software, designs, interactive map assets, and content provided by us are the intellectual property of Plotted Plants or our licensors. You may not copy, modify, or distribute our intellectual property without express permission.

7. Termination

We reserve the right to suspend or terminate your account or access to the Services at any time, for any reason, including violations of these Terms.

8. Disclaimers and Limitations of Liability

  • Service Availability: The Services are provided “as is” and “as available.” We do not guarantee uninterrupted access and may update or modify features at any time.
  • No Gardening Guarantees: Plotted Plants provides software tools for garden management. We are not responsible for the success or failure of your plants, weather events, or physical garden conditions.
  • Limitation of Liability: To the maximum extent permitted by law, Plotted Plants shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.

9. Governing Law

These Terms are governed by the laws of Pennsylvania, United States of America. Any disputes shall be resolved in the appropriate courts located in Philadelphia, Pennsylvania.
